These Terms of Service (“Terms”) govern your access to and use of restaurant.art (the “Site”) and any products or services offered by Pink Koala LLC (“we,” “us,” or “our”). By using the Site or placing an order, you agree to these Terms and to our Privacy Policy.

1) Who We Are

restaurant.art is owned and operated by Pink Koala LLC:

2) Eligibility & Use

You must be at least 18 (or the age of majority in your jurisdiction) to place orders. You agree to use the Site only for lawful purposes and in accordance with these Terms.

3) Orders, Pricing & Taxes

• When you place an order, you offer to buy the products in your cart under these Terms. We may accept or decline any order.
• Prices are shown in USD and may change without notice prior to checkout. Applicable sales tax is calculated at checkout.
• We reserve the right to correct pricing or availability errors and to cancel orders that result from such errors (we’ll notify you and refund promptly).

4) Payments

• Payments are processed securely by our third-party processor (e.g., Stripe). We do not store full card numbers.
• By submitting a payment, you authorize the charge to your selected payment method for the order total, taxes, and any applicable fees.

5) Shipping, Delivery & Risk of Loss

• Shipping across the contiguous U.S. (lower 48 states) is free for standard service. See details at Order Processing & Shipping.
• Delivery estimates are not guarantees; actual delivery times depend on carrier performance and other factors.
• Title and risk of loss pass upon delivery to the address you provide.

6) Returns & Refunds

Our return policy is available at Returns. If something arrives damaged, defective, or incorrect, contact us and we’ll make it right.

7) Custom Artwork & Your Content

• Your photos/content. If you submit or upload photos or other material (“User Content”), you represent and warrant you have all necessary rights to do so (including any third-party permissions) and that the content does not infringe, violate, or misappropriate any rights or laws.
• License to us (limited). You grant us a non-exclusive, worldwide, royalty-free license to host, process, adapt, and reproduce your User Content solely to create, fulfill, deliver, and support derived custom artwork (including reprints/replacements and backups). We will not use your User Content for advertising or our public portfolio without your separate permission.
• AI-assisted process. Our creative process may include AI-assisted tools guided by human direction. Final results may vary from previews and are part of the creative process you are commissioning.

8) Intellectual Property

• The Site, templates, product photography, text, graphics, logos, and other materials are protected by intellectual property laws and are owned by us or our licensors.
• Except for your limited User Content license above, you obtain no rights in our IP. You may not copy, modify, distribute, or create derivative works from our IP without prior written consent.

9) Acceptable Use

• No unlawful, infringing, harassing, or harmful activity.
• No attempts to probe or circumvent security or to disrupt the Site.
• No scraping or automated extraction without our written permission.

10) Disclaimers

EXCEPT AS EXPRESSLY PROVIDED IN THESE TERMS OR REQUIRED BY LAW, THE SITE AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. Some jurisdictions do not allow limitations on implied warranties; some limitations may not apply to you.

11) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR PURCHASE OF PRODUCTS. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE ORDER GIVING RISE TO THE CLAIM. Some jurisdictions do not allow certain limitations; some limitations may not apply to you.

12) Indemnification

You will defend, indemnify, and hold harmless Pink Koala LLC and its affiliates from any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your User Content, your violation of these Terms, or your violation of any law or third-party rights.

13) Privacy

Your use of the Site is also governed by our Privacy Policy, which describes how we collect, use, and disclose personal information, including California disclosures.

14) Governing Law; Venue

These Terms are governed by the laws of the State of California, without regard to its conflict of laws rules. Subject to the arbitration provision below, the state and federal courts located in Sacramento County, California will have exclusive jurisdiction for any suit not subject to arbitration, and you consent to their personal jurisdiction.

15) Arbitration & Class Action Waiver

Any dispute arising out of or relating to these Terms or the Site will be resolved by binding individual arbitration under the JAMS Consumer Arbitration Rules. You and we waive any right to a jury trial and to participate in a class or representative action. You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing support@restaurant.art with the subject “Arbitration Opt-Out” and your full name and address.

16) Electronic Communications

By using the Site, you consent to receive communications from us electronically (e.g., email, on-site notices). You agree that all notices we provide electronically satisfy any legal requirement that such communications be in writing.

17) Changes to the Terms

We may update these Terms from time to time. If we make material changes, we’ll post the new Terms on this page and update the “Last updated” date. Continued use of the Site after changes become effective constitutes acceptance.
